By using this website or placing an order, you acknowledge and agree to the following terms and conditions. These terms may be updated or modified at any time, without prior notice, at the sole discretion of Big Purple Box Inc. (“BPB”). Continued use of the site or services constitutes acceptance of the most current version of these terms.
1. Website Use and Legal Jurisdiction
This website and any transactions made through it are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. You agree to comply with all applicable laws and regulations.
We make reasonable efforts to ensure the accuracy of the content on this site. However, we reserve the right to correct any errors, inaccuracies, or omissions and to update product information, pricing, and availability at any time without prior notice.
Use of this website is at your own risk. BPB makes no warranties or guarantees regarding the accuracy, completeness, or reliability of content. We are not responsible for any loss, damage, or inconvenience caused by reliance on website information or linked third-party sites.
2. Equipment Rental Agreement
When you rent equipment from Big Purple Box Inc., the following terms apply:
2.1 Equipment Rental
You agree to rent the items listed on your invoice for temporary use. All equipment remains the property of BPB at all times.
2.2 Rental Charges
Rental charges are based on the rates outlined in your invoice and begin on the day equipment is delivered. The rental period ends when the equipment is picked up by BPB. Weekly extension fees will automatically apply for items not returned on schedule:
- $1 per box per week
- $1 per linen bag per week
- $1 per dolly per week
2.3 Equipment Condition & Care
All items are inspected before delivery to ensure they are clean and functional. You are responsible for inspecting your delivery upon receipt and reporting any issues within 1 business day. After this window, all items are considered delivered in acceptable condition.
While in your possession, you are responsible for the care and safe use of the equipment. Items must not be altered, marked, or damaged. You may be billed for excessive dirt, misuse, or mishandling.
2.4 Loss, Damage & Replacement Costs
Replacement fees for lost or damaged items (beyond normal wear and tear) are as follows:
- $50 per dolly
- $30 per box
- $20 per linen bag
These charges will be automatically applied to the credit card on file.
3. Payment Terms
3.1 Accepted Payment Methods
Full payment is due at delivery. We accept Visa, MasterCard, Amex, or cheque (must be backed by a valid credit card on file).
3.2 Ongoing Charges
If you extend your rental beyond the original term, you authorize BPB to charge your card for any additional rental time, damages, or replacement costs.
3.3 NSF Fees
Returned cheques are subject to a $20 non-sufficient funds fee, charged to your card on file.
4. Risk of Loss & Liability
Once the equipment is delivered, you assume all responsibility for loss or damage, regardless of cause. BPB is not liable for any personal injury, property damage, or loss that may result from the use or misuse of our rental equipment.
You agree to use all equipment in a safe and lawful manner. You waive any claim against BPB for any damages arising from use of the rented items.
5. Breach & Termination
You will be considered in breach of this agreement if:
- Payment is not received on time
- Any other term of this agreement is violated and not corrected within 5 days of notice
- You are declared bankrupt or insolvent
If you breach this agreement, BPB reserves the right to reclaim all rented equipment and demand immediate payment of outstanding fees. You will also be responsible for any legal or recovery costs incurred.
6. Order Fulfillment and Service Limitations
While we aim to fulfill all orders promptly and within estimated timelines, BPB is not liable for delays caused by events beyond our control, including delivery service interruptions or inclement weather. We also reserve the right to decline service to certain addresses.
7. Privacy Policy
Your use of this site is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information.
8. Entire Agreement
This Terms & Conditions document constitutes the entire agreement between you and Big Purple Box Inc. and supersedes any prior understandings or agreements related to the subject matter.
